Privacy notice

1Identity and address of the data controller

[Legal name of the data controller], doing business under the trademark TELOS (hereinafter “TELOS” or the “Controller”), with address for notices at [Street, number, neighborhood, ZIP code, city and state], Mexico, and contact email hello@jointelos.pro, is responsible for the processing of your personal data, for the use given to them and for their protection.

2Personal data we collect

We collect only the data necessary for the purposes described in this notice:

a) Data you provide in the “Tell us what you’ve built” form

Name; email address; name of your project or channel; main platform; URL of your public profile; approximate audience size; current form of monetization; a description of what you would like to build; and any additional information you choose to share in the field “What should we know about you?”.

b) Data we collect when you write to us

Your email address, your name and the content of the messages you send to hello@jointelos.pro or build@jointelos.pro, as well as of any subsequent conversations.

c) Browsing data collected automatically

IP address, browser type and version, operating system, date and time of access, pages viewed and referring URL, recorded in our server’s technical logs for security and operational purposes.

Sensitive data. We do not request or collect sensitive personal data (racial or ethnic origin, health status, genetic information, religious or philosophical beliefs, union membership, political opinions, sexual preference) or financial or asset data through the site. Please refrain from including them in free-text fields. If you nonetheless choose to include them, we will understand that you consent to their processing solely to evaluate your proposal, and we will delete them as soon as they are no longer necessary.

Third-party data. If you share personal data of other people (collaborators, partners, team members), you represent that you have their authorization and the necessary authority to do so, and you undertake to inform them of the content of this notice.

Minors. The site and our services are intended for adults with legal capacity to contract. We do not knowingly collect data from minors. If we become aware of having received such data, we will delete it.

3Purposes of processing

Primary purposes — necessary for the relationship you initiate with us:

1. To receive, record and evaluate the proposal you send us.
2. To contact you for follow-up, request additional information and schedule conversations.
3. Where applicable, to negotiate, formalize and manage a contractual or collaboration relationship.
4. To manage our communication with you and respond to your requests.
5. To ensure the security, integrity and proper functioning of the site, and to prevent fraud or misuse.
6. To comply with applicable legal obligations and respond to requests from competent authorities.

Secondary purposes — not necessary, but which allow us to serve you better:

7. To send you communications about TELOS news, content, events and opportunities.

If you do not want your data processed for the secondary purpose, you may say so now or at any later time by emailing hello@jointelos.pro with the subject “No communications”. Your refusal will not be grounds for us to stop evaluating your proposal or to deny you any service.

4Consent

By ticking the acceptance box and submitting the form, you give your express consent to the processing of your personal data in accordance with this notice. With respect to browsing data, your tacit consent is understood to be given by continuing to use the site after this notice has been made available to you, under the terms of the Law. The URL of your public profile is considered to be obtained from a publicly accessible source and is processed solely for the purposes described here.

5Transfers and processors

TELOS does not sell, rent or share your personal data with unrelated third parties for purposes other than those stated. Data may only be transferred in the following cases:

1. To competent authorities, where there is a duly founded and reasoned request or where necessary to exercise or defend rights.
2. In the event of a merger, spin-off, acquisition or any corporate restructuring, to the successor or acquirer, who will assume the obligations of this notice.
3. In the other cases provided for in the article of the Law on transfers that do not require consent.

Processors. To operate the site we use providers that process data on behalf of TELOS, under our instructions and without authority to use them for their own purposes: the provider of the infrastructure and hosting of the site and email, and, where applicable, the provider of the form or transactional email service. Some of these providers may be located outside Mexico; in such cases we contractually require protection measures equivalent to those provided for in the Law.

Third-party resources. For its operation, the site loads typefaces from Google Fonts (Google LLC) and a scrolling library from the jsDelivr content delivery network. When these load, your browser transmits technical data such as your IP address to those providers, in accordance with their own privacy policies. We do not share any form data with them.

6Cookies and similar technologies

As of the last update of this notice, the site does not install first- or third-party cookies for tracking, advertising or analytics purposes, and does not use web beacons or tracking identifiers. If we incorporate measurement tools in the future, we will update this notice and, where the Law requires it, request your consent. You may in any case configure your browser to block or delete cookies and local storage.

7Retention period

We keep your data only for as long as necessary to fulfil the purposes of this notice and the periods required by applicable legal provisions:

• Proposals. During evaluation and, if no relationship is formalized, for up to twenty-four months from the last contact, so that the conversation can be resumed. After that period the data will be blocked and subsequently deleted.
• Formalized relationships. For the duration of the relationship and, afterwards, for the limitation and retention periods established by commercial, tax and civil laws.
• Browsing logs. For up to twelve months, unless they are needed to investigate a security incident.
• News communications. Until you revoke your consent or object to receiving them.

8Rights of access, rectification, cancellation and objection (ARCO)

You have the right to access your personal data and to know the details of their processing; to rectify them when they are inaccurate or incomplete; to cancel them when you consider they are not required for any of the purposes of this notice, are being used for purposes you did not consent to, or the relationship has ended; and to object to their processing for specific purposes.

To exercise any of these rights, send a request to hello@jointelos.pro with the subject “ARCO rights”, including:

1. Your full name and a means of communicating our response to you (email or postal address).
2. A copy of a document proving your identity (valid official ID) or, where applicable, the legal representation of the person acting on your behalf.
3. A clear and precise description of the personal data regarding which you seek to exercise the right, and of the right you wish to exercise.
4. Any other element or document that helps locate your data and, in the case of rectification, the documentation supporting the requested change.

We will communicate our decision within a maximum of twenty business days from receipt of your complete request; if it is granted, it will take effect within the following fifteen business days. These periods may be extended once for an equal period where justified, of which you will be notified. Exercising your rights is free of charge; only justified shipping costs or the cost of reproduction in copies or other formats may be charged. If your request does not contain the necessary information, we will ask you to complete it within the following five business days.

9Revocation of consent and limitation of use or disclosure

You may revoke the consent you have given us at any time, without retroactive effect, and ask us to limit the use or disclosure of your data, through the same procedure provided for ARCO rights. Please note that revocation may mean that we are unable to continue evaluating your proposal or to maintain the relationship initiated. For the purpose of communications, we also keep an internal exclusion list in which we will enter your email address at your request.

10Security measures

We have implemented reasonable administrative, technical and physical security measures to protect your data against damage, loss, alteration, destruction or unauthorized use, access or processing: encryption of communications with the site via HTTPS, server access exclusively through cryptographic keys, access to proposals restricted to the co-founders and authorized personnel bound by confidentiality, and backups. No security measure is infallible; in the event of a breach that significantly affects your economic or moral rights, we will inform you without delay so that you can take the appropriate measures.

11Changes to this privacy notice

This notice may be modified, changed or updated as a result of new legal requirements, our own needs or changes in our privacy practices. Any modification will be published at jointelos.pro/aviso-de-privacidad.html (Spanish, binding version) and at jointelos.pro/en/privacy-notice.html, with the date of its last update. Where a change substantially affects the purposes or transfers, we will also notify you by email.

12Authority

If you believe that your right to the protection of personal data has been violated by any conduct or omission on our part, or you presume any violation of the provisions of the Law, you may file a complaint with the competent authority for personal data protection in Mexico (currently, the Secretaría Anticorrupción y Buen Gobierno).
